The agreement between you and the company that operates VisaBid.

Read this first, because it is the part people get wrong

VisaBid does not give immigration assistance. When you engage a provider through this platform, the professional relationship - and the money - is between you and them. We introduce, we generate the paperwork the law requires, we keep the record, and we can act on a dispute. We are not your migration agent and we are not your lawyer.

1. Who we are

VisaBid is operated by MultiTasker LLC, a limited liability company registered in the State of Wyoming, United States of America, with its registered office at 30 N Gould St, STE R, Sheridan, WY 82801, United States of America. In these terms "VisaBid", "we", "us" and "our" mean that company.

VisaBid is a service name of MultiTasker LLC, not a separate company. No company has been registered under the name VisaBid, and every agreement, invoice and payment on this site is made by MultiTasker LLC. If you need to identify the party to this agreement - to give notice, to make a claim, or to look us up on a company register - it is MultiTasker LLC.

We are not an Australian company and we do not hold an Australian financial services licence, an Australian credit licence, or registration as a migration agent. We say so plainly because a platform in this market that is vague about what it is licensed to do is a platform to be careful of.

2. What VisaBid is, and is not

It is an online marketplace where a person describes an Australian immigration matter and providers who are legally entitled to act send written quotes; a set of tools that generate the consumer guide acknowledgement, service agreement, invoices and receipts the Migration Agents Code of Conduct requires; and a durable record of what was agreed and what happened.

It is not a migration agency, a law practice, a financial service, an escrow agent, an insurer, or an employer or agent of any provider. We do not review your documents, form a view on your prospects, or supervise professional work.

Only a registered migration agent or an Australian legal practitioner may give immigration assistance in Australia for a fee. If anything on this platform ever reads as advice about your matter, we have made a mistake and we want to hear about it at trust@visabid.io.

3. Eligibility and your account

4. Verification, and what our badge does and does not mean

Before a provider can quote, we check their claimed credential against the public register, record the expiry date, and ask for their registration or practising certificate and evidence of professional indemnity insurance. We re-check periodically and suspend a profile automatically when a recorded registration expires.

"Verified" means we checked that this person was entitled to give immigration assistance and that their registration was current when we looked. It is not a quality rating, an endorsement, a recommendation, or any assurance about the outcome of your matter. We are not the regulator. The register is public and free, and you should check it yourself before you pay anyone.

5. Quotes, engagement and the professional relationship

A quote is an offer by the provider, not by us. Accepting a quote opens an engagement on this platform and declines the other quotes on that case. It does not start work and it does not authorise any payment.

Work and payment become possible only after the sequence the Code of Conduct requires: you are given the consumer guide, a written service agreement is issued, and both of you sign it. The service agreement is between you and the provider. VisaBid is not a party to it, does not guarantee the provider's performance of it, and has no authority to vary it.

6. Payments

Payments for professional fees are made to the provider, processed by Stripe, with the provider as merchant of record. VisaBid does not hold your money. Government charges such as the visa application charge are paid by you directly to the Department of Home Affairs and never pass through this platform or through us.

We charge the provider a service fee on professional fees paid through the platform. We do not charge applicants. Full detail, including refunds, is in the payments, fees and refunds policy, which forms part of these terms.

7. Your content, and what we may do with it

You keep ownership of everything you upload. You grant us a licence to store, copy and display it only as far as is necessary to run the platform, provide it to a provider you have engaged, resolve a dispute, or comply with the law. That licence is not a licence to publish, sell, or train anything on your material.

You must have the right to upload what you upload, and it must be true. Giving false or misleading information or documents in connection with an Australian visa application is a serious criminal offence, and the consequences fall on you long after any refund would help.

8. Reviews

A review can only be left by a client who completed an engagement through the platform, one per engagement. We publish reviews as written, subject to our acceptable use policy. We do not remove a review because the provider dislikes it, and we do not accept payment to promote, demote, suppress or reorder reviews. A provider may reply publicly once.

9. Availability

We aim to keep the platform available but do not promise uninterrupted service. We may suspend it for maintenance, security, or where required by law. Where a suspension is planned and material, we will give notice.

10. Suspension and termination

You may close your account at any time. We may suspend or close an account where there is a reasonable basis to believe these terms or the acceptable use policy have been breached, where a provider's credential lapses or is cancelled, or where required by law.

Except where an immediate suspension is necessary to prevent harm or a criminal offence, we will tell you the reason and give you a reasonable opportunity to respond. Closing an account does not end an engagement already on foot between you and a provider, and does not affect money already owed either way.

11. Our liability

This section is written to be lawful rather than maximal, and the difference matters to you.

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. If any part of this section would have that effect, it does not apply to that extent. Under the ACL our services come with guarantees that cannot be excluded, including that they will be provided with due care and skill.

Subject to that, and to the extent the law permits:

12. Indemnity

If you are using VisaBid in the course of a business - which in practice means providers - you indemnify us against loss we suffer arising from your breach of these terms, your breach of the Code of Conduct or the Legal Profession Uniform Law, or your provision of immigration assistance. That indemnity does not extend to loss caused by our own breach, negligence or wrongful act, and it does not apply to consumers.

13. Governing law

These terms are governed by the law of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of its courts.

We are a United States company and could have chosen our own law and our own courts. We have not, for two reasons. It would be of no practical use - the Australian Consumer Law reaches a foreign company that carries on business in Australia regardless of what its contract says. And requiring an Australian consumer to sue in Wyoming is exactly the kind of term the unfair contract terms regime exists to strike down, which since November 2023 carries a penalty rather than merely being unenforceable.

14. Changes

We may change these terms. We will give registered users at least 14 days' notice of a material change by email and on the platform, and the version and date at the top of this page will change. If you do not accept a change, you may close your account; changes do not apply retrospectively to an engagement already under way.
